Welcome to Courier Uncle. These Terms & Conditions (“Terms”) govern your access to and use of the Courier Uncle website and services. By accessing or using our website or services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you must not use our services.
1. Services
Courier Uncle is a technology-enabled logistics aggregation platform that facilitates shipping, courier, fulfillment, reverse logistics, and related services by connecting business merchants with independent third-party courier partners across India.
2. Eligibility
You must be at least 18 years of age and legally competent to enter into a binding contract under applicable laws. If you access or use our services on behalf of a company or other legal entity, you represent and warrant that you are duly authorized to bind such entity to these Terms.
3. Merchant Responsibilities
By using our services, you agree to:
- Provide accurate, complete, and up-to-date shipment and business information.
- Ensure that all shipments comply with applicable laws and regulations.
- Properly package all shipments to prevent damage during transit.
- Not ship any prohibited, hazardous, counterfeit, illegal, or restricted items, as set out in Section 4 (Hazardous, Prohibited & Restricted Items) below.
- Maintain a sufficient balance in your Courier Uncle wallet to cover shipping and other applicable charges, as set out in Section 6 (Wallet, Balance & COD) below.
- Obtain a signature on the pickup manifest, and a handover video where the courier partner requires one, at every handover, as set out in Section 8 (Pickup, Handover & Proof of Handover) below.
- Pay all applicable shipping charges, taxes, duties, and other fees.
- Comply with the policies and operational requirements of Courier Uncle and its courier partners.
4. Hazardous, Prohibited & Restricted Items
Courier Uncle reserves the right to refuse, suspend, or cancel any shipment containing hazardous, prohibited, or restricted items (“Notified Goods”), including but not limited to the items listed below, or any item prohibited under applicable law or courier partner policies.
The following are treated as Notified Goods and must not be booked or handed over without prior written intimation to, and written acceptance by, Courier Uncle:
- Oil-based paints and thinners / flammable liquids
- Industrial solvents
- Insecticides and garden chemicals, including fertilizers/poisons
- Lithium batteries
- Magnetized materials
- Machinery containing fuel or that has previously contained fuel, including chainsaws/outboard engines
- Fuel for camp stoves, lanterns, torches or heating elements
- Automobile batteries
- Infectious substances
- Toxic compounds, liquids or gases
- Bleach
- Flammable adhesives
- Arms and ammunition
- Firearms
- Explosives
- Military equipment
- Dry ice / Carbon Dioxide (Solid)
- Pressurized containers
- Narcotic substances / illegal substances
- Poison
- Hazardous chemicals
- Radioactive materials
- Foodstuff and liquor
- Pornographic material
- Cash, currency and coins
- Gold, silver, diamonds and jewellery
- Live animals/birds
- Plants
- Human/animal remains
- Counterfeit/pirated products
- High-value products shipped without the required approval/insurance
- Any other item prohibited under applicable Indian law or courier/transportation regulations
4.1 Disclosure obligation for hazardous/hazmat products
Where a Seller books or hands over any hazardous or hazmat product, the Seller must provide Courier Uncle with the complete composition of the product and its flammable categorization, along with any other information Courier Uncle may reasonably require to assess and handle the shipment safely, before the shipment is booked or handed over for pickup.
4.2 Consequences of incorrect or non-disclosure
In case of incorrect, incomplete, or non-disclosure of the information required under Section 4.1, the Seller shall be solely responsible for any resulting loss, damage, claims, penalties, liabilities, and expenses, and shall indemnify and keep indemnified Courier Uncle, its officers, employees, and courier partners against all such loss, damage, claims, penalties, liabilities, and expenses.
4.3 Liquidated damages
If any Notified Goods are booked or handed over to Courier Uncle without prior intimation as required above, or with an incorrect or inaccurate description, the Seller shall be liable to pay Courier Uncle ₹30,00,000 (Rupees Thirty Lakhs) per instance as liquidated damages, without prejudice to Courier Uncle's other rights and remedies. Courier Uncle shall have the right to adjust or recover this amount from any amount otherwise payable to the Seller, including wallet balance, COD remittances, or invoiced dues.
5. Pricing & Payments
Shipping charges are determined based on the selected courier partner, shipment weight, dimensions, destination, applicable surcharges, and taxes. All payments must be made in accordance with the applicable payment terms. Courier Uncle reserves the right to revise pricing, fees, or service charges at any time without prior notice.
6. Wallet, Balance & COD
Sellers are required to maintain sufficient balance in their Courier Uncle wallet to cover shipping charges and other applicable fees. If there is insufficient balance in the Seller's wallet, Courier Uncle may stop or hold the Seller's services, including new bookings, pickups, and label generation, until the wallet is replenished.
Where applicable charges, fees, penalties, or liquidated damages under these Terms exceed the available wallet balance, including where Cash on Delivery (COD) amounts (whether collected by the courier partner or through the Courier Uncle COD QR on the Seller's behalf) are due to be remitted to the Seller, Courier Uncle may withhold the applicable amount, in whole or in part, until the pending amount is cleared and the wallet balance is replenished.
7. Shipment, Delivery & COD Remittance
Delivery timelines are estimates provided by courier partners and are subject to operational conditions. Courier Uncle does not guarantee delivery within any specific timeframe. Cash on Delivery (COD) remittances shall be processed in accordance with the settlement timelines and policies of the respective courier partner, subject to Section 6 (Wallet, Balance & COD) above.
8. Pickup, Handover & Proof of Handover
At the time of pickup, the Seller (or the Seller's authorized representative at the pickup location) must obtain a signature on the courier partner's pickup manifest from the rider or courier representative collecting the shipment. Some courier partners additionally require a short video recording of the handover(showing the parcel and its condition at the time of pickup) as a precondition to processing any claim, and will not entertain a claim without one.
A shipment reported by the Seller as lost, stolen, tampered with, or damaged after pickup shall be investigated with the respective courier partner in accordance with that courier partner's claims process. Where the Seller has not obtained a signed pickup manifest, and, where applicable, a handover video, Courier Uncle's ability to raise or recover such a claim with the courier partner may be limited or refused, and Courier Uncle shall not be liable for any resulting loss, theft, or damage, or for the courier partner's refusal to honor the claim on that basis.
Sellers are strongly advised to follow this practice at every handover, regardless of shipment value, as proof of handover is often the only basis on which a courier partner will process a claim.
9. Cancellation & Refunds
Shipment cancellation requests shall be governed by the policies of the respective courier partner and may not be accepted once a shipment has been picked up or dispatched. Refunds, where applicable, will be processed in accordance with Courier Uncle's Refund Policy.
10. Limitation of Liability
Courier Uncle operates solely as a technology platform facilitating logistics services through independent third-party courier partners. To the maximum extent permitted under applicable law, Courier Uncle shall not be liable for any delay, loss, damage, theft, non-delivery, indirect, incidental, special, or consequential damages, loss of profits, or business interruption arising from the acts, omissions, or services of any third-party courier partner.
11. Intellectual Property
All trademarks, trade names, logos, software, content, graphics, designs, text, and other intellectual property available on the Courier Uncle website are owned by or licensed to Courier Uncle and are protected under applicable intellectual property laws. No content may be copied, reproduced, distributed, or used without prior written permission.
12. Privacy
Your use of our website and services is also governed by our Privacy Policy, which explains how Courier Uncle collects, uses, stores, and protects your personal information.
13. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.
14. Changes to These Terms
Courier Uncle reserves the right to amend, modify, or update these Terms & Conditions at any time. Any revised Terms will be published on this website and shall become effective immediately upon publication. Continued use of the services after such changes constitutes acceptance of the revised Terms.
